Termination Without Notice in the UAE: Key Legal Checks

Being dismissed without notice can raise important questions for employees and employers. The first step is to distinguish ordinary contract termination from the specific legal grounds that may allow termination without notice.

Key point

For private sector employment governed by Federal Decree Law No. 33 of 2021, as amended, the law identifies specific situations in which an employer may dismiss a worker without notice. This is not a general permission to skip process or contractual obligations.

1. Check which employment rules apply

Start with the signed employment contract, work permit, employer's legal entity and work location. Federal private sector rules do not necessarily apply in exactly the same way to every employment category, public sector role or financial free zone arrangement.

2. Understand Articles 44 and 45

Article 44 addresses specified circumstances in which an employer may terminate a worker without notice. Official UAE Government guidance notes procedural requirements, including a written investigation and a written, justified dismissal notice in the relevant cases.

Article 45 separately addresses circumstances in which a worker may terminate employment without notice. Some grounds involve procedural steps, such as notifying MoHRE of the employer's breach and allowing the relevant opportunity to remedy it. The conditions differ by ground and should be checked carefully before relying on them.

3. Preserve the record before responding

4. Check the practical consequences

Termination can affect notice pay, outstanding salary, unused leave, end of service benefits, work permit processes and any claim relating to the termination. The outcome depends on the facts and applicable legal framework. Do not assume a dismissal is lawful merely because it is labelled misconduct, or unlawful solely because no notice was given.

5. Use the correct dispute channel

For many private sector employment disputes, MoHRE is a starting point for complaint and settlement procedures. Other employment regimes may have their own competent authority or dispute process. Check official guidance before filing and observe any deadlines that apply to your claim.
