UAE evidence legislation recognises forms of electronic evidence, including electronic correspondence and modern communication methods. Whether a particular message is accepted and what weight it carries depends on the law, authenticity, context, integrity and facts of the dispute.
Can WhatsApp messages be used in a UAE dispute?
Federal Decree by Law No. 35 of 2022, the Law of Evidence in Civil and Commercial Transactions, includes electronic instruments, electronic correspondence, modern means of communication, electronic media and other electronic evidence. The law does not mean that every screenshot proves everything a sender says it proves.
A court or decision maker may need to consider who sent the message, whether the record is complete and reliable, the surrounding conversation, whether the content has been altered and how the message relates to the issue being decided.
How to preserve a conversation
- Keep the original conversation. Avoid deleting messages or relying only on a cropped screenshot. Keep the relevant chat on the original device where possible.
- Capture the surrounding context. Preserve messages before and after the key statement, dates, times, participants and any relevant group information.
- Keep related records. Save the underlying contract, invoice, bank record, delivery confirmation, email or document referred to in the conversation.
- Do not edit the evidence. Do not add annotations to the only copy or alter the text. If you need a working copy, preserve an untouched original separately.
- Record how the material was obtained. Keep the device, account and export details where appropriate. Do not access someone else’s account or device without lawful authority.
- Protect private information. Share only what is relevant through an appropriate channel. A conversation may contain personal data or information about third parties.
Why a screenshot may not be enough
A screenshot can show a portion of a conversation, but it may not reveal the full context, whether messages were edited, how the sender was identified or whether an attachment forms part of the exchange. The importance of the surrounding records depends on the point in dispute.
Where the matter is significant, ask how the original digital record should be preserved and whether technical verification, an expert or a certified translation may be needed. Do not assume that a translation or printout automatically resolves questions about authenticity.
What if a message is in Arabic and the case materials are in English?
Keep the original-language record. If a translation is required for a particular procedure, use an appropriate translator and keep the translation linked to the original. Translation should preserve the meaning, date, speaker and relevant context rather than paraphrase the conversation.
Questions people commonly ask
Are WhatsApp messages automatically accepted as proof?
No. Electronic evidence is recognised by UAE law, but the reliability and relevance of a particular record still matter. The legal issue and forum affect what needs to be shown.
Can I rely on a cropped screenshot?
A cropped screenshot may be incomplete. Keep the full conversation and source records where possible, and identify exactly what the screenshot is intended to establish.
Should I send my entire chat history with an enquiry?
Usually, start with a short summary and the key issue. Avoid sending sensitive or unrelated personal conversations until an appropriate channel and a clear need have been agreed.
